This Privacy Policy explains how we collect, store, use and disclose your personal information (or personal data, as it is referred to under the General Data Protection Regulation (GDPR)). This policy applies to you when you use our website or interact with us through social media, provide us with information, or purchase our products or services. 

We adhere to the New Zealand Privacy Act 2020 and, to the extent applicable, the GDPR.

What personal information do we collect?

Personal information is information that can be used to identify a person. This may include your name, date of birth, contact details (such as email address, phone number, physical address), user name and password, IP address, credit or debit card details, customer survey feedback and details of products or services you’ve purchased, ordered or enquired about. It could also include technical information from your device regarding the service you receive. If you are based in the European Union (EU), it also includes any other information we collect about you that is defined as personal data under the GDPR.

You may only share the details of another person with us where you have their express permission.

How do we collect your personal information? 

Where possible, we collect your personal information directly from you via email, phone, website forms, surveys, and electronic messages. In some circumstances, we may also collect it from:

  • third parties who you have permitted to share your personal information with us
  • our agents or representatives, some of whom are located in countries other than New Zealand or in the EU
  • publicly available sources
  • information we collect using cookies stored on your device about your use of our website.

For what purposes do we process your personal information?

We collect, store, use and disclose your personal information for the purposes of providing you with products and services, and manage and develop our business, including:

  • marketing (where permitted by law or with your consent) our products and services and those of our related companies and business partners that may interest you, or informing you of updates to our products or services
  • improving your personal experience on our website 
  • compiling customer reviews
  • delivering our products and services to you
  • conducting customer research and data analytics about our products and services, and improving or developing our products and services
  • handling complaints and disputes
  • collecting any money you owe us
  • carrying out statistical, technical and logistical analysis and strategic development
  • communicating with you, such as responding to questions or comments from you  
  • complying with our contractual or legal obligations or enforcing our legal rights 
  • assessing and processing employment applications and managing employment disputes and
  • any other purposes expressly authorised by you in writing

We will only use your personal information for the purposes we collected it. If you are based in the EU, we will also comply with the GDPR requirements regarding the use of personal data. 

We do not collect or process any personal information from you that is considered "Sensitive Personal Information" under the GDPR, including personal information relating to your sexual orientation, ethnic origin, health, religious beliefs or political opinions.

You must not provide us with your personal information if you are under the age of 16 without the consent of your parent or someone who has parental authority for you. We do not knowingly collect or process children's personal information.

We will retain your personal information only for as long as it is necessary for the purposes for which it may be used, after which we will delete it from our systems. If you are based in the EU, we will also comply with the GDPR requirements regarding the retention and deletion of personal data.

Who do we disclose your personal information to and why?

We may disclose your personal information to others for the purposes specified in the section above. This may include disclosure to:

  • our related and group companies
  • our distributors and agents
  • our suppliers that we engage to help us or work with us to provide products and services
  • our advisers (including legal and accounting advisers) and service providers, including marketing organisations, credit check and debt collection agents, cloud-providers
  • your employer
  • other third parties as required by law (including any legal obligations under the GDPR for our customers based in the EU)
  • in connection with, or during negotiations of, any sale of our assets or acquisition or all or a portion of our business 
  • anyone else expressly authorised by you in writing

International Data Transfers

In some instances, to provide our products or services or to efficiently conduct our business activities, your personal information might be stored, processed in or transferred between our related companies, business partners and service providers that may be located outside of New Zealand (and to the extent applicable, outside the EU). The countries where these recipients may be located may include European Union, New Zealand, United Kingdom, United States of America, Japan, India, Australia and United Arab Emirates and other countries where we have a presence. 

For data transfers from New Zealand, you authorise us to disclose your personal information to overseas recipients as described in this policy and otherwise as permitted under the Privacy Act 2020.  

Under the GDPR, personal data may be transferred to a country outside the EU where the European Commission has decided that the country ensures an adequate level of protection. In the absence of an adequacy decision, we may transfer personal data provided appropriate safeguards are in place. The European Commission recognises New Zealand as a country that ensures an adequate level of data protection. Where data transfers are to countries not recognised by the European Commission as providing an adequate level of data protection, we will ensure that appropriate safeguards are in place in accordance with GDPR requirements.

Safeguards and security for your personal information

We are committed to ensuring that the personal information you provide to us is secure. To prevent unauthorised access or disclosure, we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss, and unauthorised access, modification, and disclosure. These measures include using encryption technology. However, we cannot guarantee the security of any information that you transmit to us or receive from us.

Direct marketing

Where permitted by law, and with your freely given, specific, informed and unambiguous consent if you are based in the EU, we may contact you by telephone, regular mail, email, electronic messages such as SMS, and via other means with promotional material and offers of products or services from us, our related companies, as well as offers from our business partners that we consider may be relevant and of interest to you. You have the right to withdraw your consent at any time. You can unsubscribe from receiving these messages at any time by emailing us at support@powershield.com or using the opt-out function provided with the message.

How you can access and correct your personal information

You can ask us to show you what personal information we hold about you and to correct any mistakes by emailing us at support@powershield.com. If there is a legal reason we can’t let you see the information, or if we disagree with your correction, we will give you our reasons and note your requested correction. 

For our customers based in the EU, in accordance with the GDPR, you also have the right to request the erasure of your personal data, restrict its processing, or object to its processing, and the right to data portability.

We may change this policy at any time. We will publish the updated policy on this website, and where required by law, notify you of significant changes.
